What is the name of your state? Indiana

Can someone tell me if an employee goes to the DOL and wins back wages, and if the company doesn't have enough money to pay the wages, what can happen then?

Can the company file bankruptcy and not pay the amount?

Can the company just owe the money forever and not pay it?

Does any type of Liability Ins cover something like that?

Sorry if this post is not very clear or if these are stupid questions, but my son's employer is paying illegaly and he and his co-workers would like to file a complaint. However, the kind of money it would be could likely put the guy out of business, and then maybe it's not really worth messing with.

Any help is appreciated,
