What is the name of your state (only U.S. law)? Mo
I have terminal Cancer, Not Able to work the last 3 of 9 years of marrage. 95% of the assets is in my wife name. Currenty I get SS Disability, and my wife income is 65K a year. can i can alimony and how much ?

It's up to the judge. Don't count on alot.

How much disability are you receiving? How much time are the doctors giving you? If you are terminal, why are you considering divorce?

Um...maybe wants to spend remaining time happy without annoying spouse? The whole "quality" versus "quantity" of life thing.

Wife Wants the Divorce

I recieve about $1600 in disabitlily, The wife wants to get on with her life. Not have to take care of any one. She just wants to give me 10K and for me to leave.

I was caregiver to my DH before his death...I have no other legal advice really other than to say I'm so very sorry you're in this situation.

It must be heartbreaking on many levels :(

I also agree that its heartbreaking.

I am trying to be practical without coming across as callous.

If he only has 6 months to go, then 10k plus his disability could keep him decently. If he has a chance of recovering (which I am assuming is not the case since he said he was terminal) then 10k could be an insult depending on the available marital assets.

There is also the question of insurance. If a divorce would take his medical insurance away then fighting to stop or delay the divorce process could be in his best interest.

An agreement for a legal separation, with him still receiving medical insurance, and 10k or more depending on his prognosis, might actually give him a better quality of life for the time that remains for him.
