What is the name of your state? West Virginia
My wife has a judgement from a family court judge, but the person will not pay. He owns nothing nor can we find where he is working. I have been told he is not in contempt of court even though there is an order for him to pay (that is how we got the judgement). I do not understand how he cannot be jailed for the contempt, nor can I figure out how to get any money from him.
Any help would be appreciated.

This is a good question, considering most people who post on this board OWE money to someone or something ;)

I would ask about filing a complaint to garnish wages from the gent. But, if he does not have any assests or money left over to be garnished its pretty much a lost cause. Im pretty sure someone cannot spend time in jail because of debt.

I am not informed in this type of civil action so the above is just what i would do.'

I bet you thought that the work was over when you got the judgment, right?? Sorry, but in a lot of cases, getting the judgment was the easy part. On average, 79% of all civil judgments go uncollected!!

You basically have three choices:
1) Forget the judgment and move on with your life, or
2) Get educated real quick on the applicable WV laws and what you can do and how to do it, or
3) Email me and I will get you in touch with some experienced Judgment Enforcement Specialists in WV.

I have tried to e-mail you about this post but it seems I cannot.
So I guess I will try it here. :)

I may indeed be interested in any experienced Judgment Enforcement Specialists in WV. I am not by any means rich or else I would not even worry about this collection. Please bear that in mind with any recomendation.

If that person do not have assets, then he can't be forced to pay back what he owed to whoever. The creditor is out of luck.

Also, as to the post by 'combat'... if a debtor has no assets, you can't collect. DUH!!! However, you don't know if they have assets until you check, right?? And a professional Judgment Enforcer has access to both public and private databases and resources that allow him/her to find out what assets the debtor has. If they have any, then we go after them.
