What is the name of your state?PA

I have been reading posts on this forum about people having judgements against them and their bank accounts seized.How exactly do they obtain your account number? If you dont have a savings and only a checking account,in which your mortgage is automatically withdrawn,can that be touched.

I hope someone who knows the answer jumps in here. I am also curious as to how creditors obtain bank account numbers, especially if it is a new account.

Pay your bill by personal check? Once a creditor has your account info they keep in on record just in case. Many times it can be found on your credit report. Or the creditor subpeonas one of the check clearing houses for the account number. And there are some companies that track such info and sell it to others with legitimate reasons for a small fee. It's not all that hard if you know where to look.

Banking information only appears on you credit report insofar as it is related to a loan or credit card that you may have with the bank. Regular banking information does not appear on your credit report.

What I don't understand is how a creditor could get a checking account number through a clearing house because it would seem the clearing house would not have the SS number associated with accounts.

I did some reading on the net today, and an asset search can be done to locate checking and savings accounts, assuming the creditor did not have knowledge of the account from you paying your bill with it.

I did also notice that their are a lot of legal issues involved in asset searches. Some companies on the net stated that searches for judgement creditors were only legal if they were for back child support.

Under the G-L-B Act information about such bank accounts are not sold. If they are sold it is in violation of federal law. If you have ever given information to someone via check, they have what they need to levie an account.

If a creditor has a past or current address along with a legal reason stated in the Fair Debt Collection Act and they are not violating the G-L-B Act to search for the information , they can legally locate your bank through a number of methods.
