In 1998 an unathorized user charged $640.00 on my calling card. It was investigated by Sprint, and I was found not to be liable (like it was this easy). I recently requested a copy of my credit reports, and have found where they turned me over to collection. The collection agency wants proof that is was paid, or something from Sprint stating I don't owe. No luck! Sprint stated they turn over all the records to the collection agency. Can I take them to small claims court? Another idea?

Send Sprint a certified, return-receipt letter. In it, ask them for proof of the debt. Tell them that if they cannot prove that the debt belongs to you, they must immediately inform the collection agency to cease collection activity.

Then, send the collector a certified, RR letter. Tell them that you want them to provide you with proof that the debt belongs to you. Inform them that the debt was the result of fraud, and that their attempts to collect are a violation of the Fair Debt Collection Practices Act.

If they don't stop collection activity after that, post here again and we'll go from there.
