collection agency debt?

A collection agency is claiming that I owe 13,000.00 worth of medical bills. However they have only been able to produce written billing documents totaling 3,500.00. When asked for the total bills amounting to the claimed total, they have refused to produce. They've said if I want those documents I have to contact their lawyer. Their lawyer says he has no such documents. How do I know this collection agency is not trying to cheat me out of nearly 10,000.00? What can I do if they are refusing to send accurate billing statements? Georgia

You need to send the collection agency and their attorney a certified letter demanding that they provide verification for the entire amount of the debt pursuant to the Federal Fair Debt Collection Practices Act.

Advise them that if they do not provide verification or notice that the account has been closed within thirty days you intend to file suit against them in small claims court for misrepresenting the character of the debt and failing to provide the required verification upon written request.

If they do not comply, file suit against them for $1,000.00 each and continue doing so every 30 days until such time as they provide verification or notice that the account has been closed.

You also need to pay them the money for the bills that they have verified.

I have sent a letter to them requesting verification of the 13,000.00 as per the Fair Debt Collection Practices act, and they still have not provided it. The hospital bills are actually all in dispute with the hospital and the insurance provider which they failed to submit the bills to; and we have informed the collection agency of this. We can't seem to get anywhere with the hospital in providing us copies of these bills or with the hospital submitting the bills to the insurance company, they just keep turning them over to a collection agency. The collection agency is illegally keeping the amounts of the bills from us, but my complaints and threats to them have yeilded nothing. I think it is time for the legal action that you requested both to go after the collection agency, and the hospital to get our copies of the outstanding bills.

So far we have filed complaints with the FTC, the state Attorney Generals, the State department of health's regulatory office, and the insurance commissioner. No one is solving our problem...Grrr.

Dear edean,

If you have sent them the letter by CERTIFIED MAIL so you have proof that they received it, you should now go to small claims court and file a lawsuit against them for $1,000.00 for failing to provide you the verification.
