I missed 2 payments to my collection agency and they served me with legal papers stating that I have 30 days to pay in full or we will have to go to court to settle account. They also added an extra 200 dollars for attorney fees and server fees. If we pay them in full before the 30 days is up do we have to pay those extra fee's that were added on as well, even though we didnt go to court?
Thanks
Alf

My response:

Yes. Because suit was already begun by them, attorney's fees and costs have been incurred by them as a result. If your contract specified attorney's fees as part of any attempt to collect, then you are on the hook for the principle amount, plus these costs and fees.

If you can pay the whole debt, call opposing counsel. Everything is negotiable. For example, now that the matter is with an attorney, if you have a $1,000.00 debt, an attorney might now accept $500.00 to settle the entire matter!! Yes, it's true. But, you'll never know until you try.
