collection agency wants what we don't owe.

Our state is OK. My husband received a call from a collection agency two nights ago. They say he owes a bill of over $4,000 from 1998. They said it was paid on from 1993 to 1998 and then we quit paying. We have no idea of what they are talking about. This is the first we have heard from them. They won't even tell us what the bill is for. All they would say is we could settle out of court for half the price of the bill. The only other thing they will do is serve a summons. We need some information. Thanks to anyone who can help.

Send them a DV letter by CRRRM. Below is a website that has sample letters that you can use.

They are SOOOOO full of crap !! The statute of limitations (longest of 5 years) has long ago run out on any debt last paid in 1998. The next time they call, and you know they will, tell them to pound sand, the debt is time-barred, SOL has run out. If they try to sue you, you have the best defense to get their BS case thrown out.

Who are these cretins anyway ??? Get their address and send them a cease and desist letter telling them never to contact you again as any debt they allege from 1998 is time-barred. Send it certified, RRR and keep copies.

What is the SOL for debts in OK? Does the time start from the time of the last payment made or from the time it is turned over to a collection agency? They say we made a last payment in 1998 but it wasn't turned over until 2000. We don't know what they are talking about but that is what they said.

SOL's in OK are 3 years for open-ended accounts, which is where credit cards fall, and 5 years for written contracts. Either way, a last payment in 1998 would mean you're 2 years past the longest SOL period. You can safely tell them to go get bent, the alleged debt is time-barred per OK statute.

What they meant by 'turned over' is that is when they either bought the debt or it was assigned to them by some junk debt buyer or creditor.
