collection agency wrong

Last week we rcv'd a letter from a collections agency stating we owed $228 to our local hospital for services rendered in Sept 2003. This was the 2nd time this had happened for the same debt.

Last time we knew we did not owe it, but because it was in collections and it was now on our credit report that a debt had been sent to collections....we paid it first and sorted it out later. The hospital agreed we did not owe and now they owed us the money back. They contacted the collections agency and told them we had a zero balance and to remove us from their books and to correct our credit report.

It took FOREVER to get an amendment added to the first page of our report that stated the debt was not past due. An amendment was necessary because it still showed as past due and sent to collections in the body of the report. Even then some creditors still saw it as a "red flag" on our report. So we had to get a legal document from the hospital stating a mistake was made on THEIR part to show to creditors.

Now they are back again. For the same debt. The hospital contacted them saying we have a zero balance, remove from books etc. AGAIN

My questions are whose responsibility is it to remove this AGAIN from our credit report and how long do they have before I can sue them and can I sue them?
 


Yes, you can and SHOULD sue!

15 U.S.C 1681n (FCRA) allows for damages for inaccurate reporting. $1000

If this collection agency pulled your credit report (as you don't owe this, they did NOT have permissable purpose): FCRA Section 604(A)(3) $1000
