Hello, I recieved a letter from Cavalry telling me they bought an old ATT wireless bill of ours. A little background info, we have proved to ATT and the three other collections that has had this debt that we do not owe this. The last proof was sent directly to ATT Wireless over a year ago from an attorney basically telling them here is the proof you are not owed and to drop it or suit would be filed. So now Cavalry has bought it and I sent in a dispute and validation letter to them. Today I got a response back teling me that I have to prove I dont owe it to them. I thought they had to prove to me that I did. Is this right??? Can I go in a file suit against ATT or did they have to right to sell it? By the way this debt is almost 5 years old.

If you are positive it is paid, then send a cease and desist letter to Calvary. You can find samples at www.creditinfocenter.com.

If Calvary sues you, then you get to make them prove you owe the money (provided you conduct discovery).

Yes, you can sue AT&T. But then, you could also sue the guy who delivers your daily newspaper. You can sue anyone for anything anytime.

The question is can you win and is the effort worth the victory? These are questions best answered by your attorney.
