collection call after 9pm on a sunday with proof!!!

Ohio is my home state

I received a collection call from first premier bank last week after 9pm and the collection rep left a message on my voicemail. It has a date and time stamp can I sue them????

Not if the call was from an original creditor - they are not bound by the FDCPA, that only applies to 3rd party collections.
