My husband and I lent our trusted financial advisor money. He was going to "loan" it to someone else and would pay us back (after he was paid back) within 30 days, with interest. It has now been 6 months and we are getting the runaround and no money. We have securities accounts with him. What are our legal rights to collect?

Would you be able to provide a copy (front and back) of the cancelled check you paid him with? Is there anything on the check (the memo portion, for example) that mentions it is a loan? How much money was lent (that determines whether you will go to small claims court or civil court)?
