What is the name of your state?OK

My Credit Card has been sent to Encore, a collection agency. They have been calling for several months.
Last week they called my father's house. I just happened to be there. I told them not to call that number again.
The next day I got a called, at work, and I asked him if he worked for Encore or Bank One. He stated Bank One. I told him I did not want them calling my father's house again.
He stated that they had been to court and they could do what ever they wanted, call whoever they wanted.
I asked again if he was from Bank One and he said yes. I asked how they could go to court and I was never notified. He said they don't have to notify me. He stated they were going to go to court again.
Yesterday this same person left a message, stating he was from Encore.
So my questions are, can I report them for saying he was a Bank One employee and calling my father's house. My understanding is that they can not call your realitives, friends, co-workers.
Also, I really don't beleive they have been to court.
What do you think?

Of course you can 'report' them... but to who?? There is nothing illegal about them saying they are from Bank One... or Encore, as Encore is very likely working as a collection agency for Bank One.

Your 'understanding' is wrong. An original creditor (Bank One) can basically do most anything they want as they are exempt from the FDCPA. And a 3rd party collection agency can contact your relatives, but only in trying to locate the debtor. There is nothing in your post to indicate that they did anything more than that.

Also, I really don't beleive they have been to court.
You are probably correct.... but not relevant.

I think you are trying to avoid your legitimate debts. If you are that concerned about their efforts to contact you.... call them.
