I am an employer based in Illinois trying to collect a debt. Is there a legal way to collect the debt by going around an agency? We've tried calling and writing. Reasoning with them does not seem to work. Do we hire a lawyer to sue and serve papers ? How does this work? Thank

You could hire a lawyer or you could file suit against the debtor yourself. How much is owed?

When suing, it is common to hire a lawyer (unless you're suing in small claims court, but $100k is beyond the limit of SCC).

How does this work?
Not sure what you're asking. Any sort of detailed explanation of how civil litigation proceeds is beyond the scope of a message board.

What type of a lawyer?
Pretty much any lawyer who does civil litigation could do it and, as noted, there are lawyers that specialize in debt collection.

The Illinois Supreme Court does not certify lawyers as specialists (some states do) so you will want to question any lawyer you contact as to their experience in debt collections.
