What is the name of your state? I currently live in Tennessee;however, the question concerns a college in Alabama.
I attended a college in ALA. My husband and I had to file bankruptcy when he became disabled...We didn't know that the student loan I had was not included in the bankruptcy. Recently, I received a letter from a collection agency demanding payment. I was not ans am not in a position to pay the loan in full at this time. I told them I could pay $100.00/mo. beginning in August. This was not agreeable with them. Now, for my question. Will they be able to garnish my wages through my job here in TN...The collection agency is in Memphis....The college is in ALA. OR, will they simply file a motion against any income tax refunds due me until the balance is paid. I want to take care of this matter, but can't do it at one time.

**A: most student loans are not dischargeable in BK. Yes, an employee garnishee can be filed.

discharge college loans by bankrupcy

according to the Feds, college loans can be discharged in only one case. The operative is "... if repayment would cause undo hardship" (here's your loop) health reasons are basically the only undo hardships considered. Tell the collector to get off your a$$ and go to the fed dept of ed to find out how.
