College Refund

What is the name of your state (only U.S. law)? North Carolina

My daughter had to drop out of community college in 2008 due to illness. She has student loans that she has to pay back but the school had already been paid. Should she get a refund? Can she claim any of that as loss on her taxes?

It depends on when she withdrew from classes; there is a deadline to withdraw after which you can't get any refund. I think it's pretty early in the semester too. It would have been handled at the time though, if she was owed a refund.

Depending on the date and severity of the illness, she might be eligible for a retro-active withdraw. Sheck into that as an option for a possible refund of some tuition.

If the school does end up keeping all the tuition, she can use THAT on her taxes (Hope Credit or Lifetime Learning Credit (I think it's called ))

And she can deduct school loan interest.

Title 23 of the N.C. Administrative Code (23 NCAC) guidelines:


1. A 100 percent refund shall be made if the student officially withdraws prior to the first day of class(es) of the academic semester as noted in the college calendar. Also, a student is eligible for a 100 percent refund if the class the student is officially registered for fails to "make" due to insufficient enrollment.
2. A 75 percent refund shall be made if the student officially withdraws from the class(es) prior to or on the official 10 percent point of the semester as noted in the college calendar.
3. Refund of fees will only be made if the student officially withdraws prior to the first day of class(es) of the academic semester as noted in the college calendar and/or if the class the student is officially registered for fails to "make" due to insufficient enrollment.

College Tuition Refund

The school actually billed her for $300 + dollars and said she owes that to them for some kind of credit they give on the student loans. So not only did the school keep her tuition money, they billed her money and has a collection agent calling her. We know several other ex-students that have the same problem. I don't understand what they are doing. Can anyone help?

When did she withdraw from the classes? How many days into the semester?
