What is the name of your state (only U.S. law)? Colorado

I have a question regarding Allocation of Parental Responsibilities in Colorado...Before a Judge issues final orders, is he/she supposed to order a custody evaluation or is this something that is a discretionary issue? I ask this because one was never done in my case and the Judge went from testimony and submission of evidence straight to final orders in the next hearing and he allowed my ex wife to keep the children.

Whether or not a judge has discretion on a particular matter is a non-issue once a final order has been signed and the time for reconsideration and appeals has passed. In such cases, any legal errors that were made are presumed to be waived and the judgment will stand.

So if a judge is doing something that they should not be doing (and it is occasionally done inadvertently), it is the responsibility of the affected party or their attorney to bring this to the judges attention for correction. Failing to do so in a timely manner waives the right to complain of this later
