Divorced in Colorado after 27 year marriage over 3 years ago
Husband ordered to pay $2650 a month in alimony
Court expects me to earn at least $1000 a month, but I have no job
Kids are adults so non-issue
Husband got laid off of job shortly after divorce
He bought a business instead of getting a new job
Business has not been profitable - no hidden earnings - very long story
He pays 20% of his pay to me, not really salary but he takes out money he loaned the company from his savings and investments
20% is what the $2650 a month was of his old salary $152K a year
He owes about $19K in past due alimony
He makes a payment or two every month but not the $2650

Questions:
I can go to court and get a contempt motion but he honestly has no assets, he has invested everything in the business which doesn't have many assets (mostly intellectual property) and he lives modestly, so what am I likely to get out of going to court?

I thought I read somewhere that back alimony in Colorado is repaid in monthly installments over a couple of years. Is this true or up to the court?

If I take him to court and he files a motion to modify alimony, what is his chances for success in adjusting my alimony down?

Does anyone have some experiences similar to this or advice for me?

Thank you for you time and assistance.

He probably will be asked why he went into a business venture "instead of getting a new job". Was there a new job for him the get??

Yes you can go to court and you're aware that you can't get blood from a stone?

Everything is up to the court.

If I take him to court and he files a motion to modify alimony, what is his chances for success in adjusting my alimony down?

50/50.

You should be looking as hard as he to support yourself. If you are expected by the court to provide yourself with $1000/ month, why aren't you doing that?

I realize that a court "expectation" is different than a court order, but you need to follow court expectations as he needs to follow court orders.

If you think he is holding out on you, then file for contempt and have his butt thrown in jail.
