What is the name of your state? TX

Would the failure to pay the commission of an employee (not an independent contractor) be a matter for the state DOL?

If so, how much past due must it be before the DOL will become involved?

What happens to commissions if the employer files for bankruptcy?

If you receive commissions only (no salary or hourly pay) and, depending upon how delayed the payments are, probably. If you receive commissions in addition to your regular pay, probably not. You can call the Texas Workforce Commission tomorrow to inquire.
