I am a psychiatrist. Myself and a social worker rent as subtenants commercial office space in NYC from a psychologist who will be leaving end of March. The landlord states he owes us no special treatment regarding the space. He is willing to draw up a new contract with us charging us 19% more if he doesn't fix it, 23% more if we request that he fix it. (It really needs to be fixed.) Do we have any rights as subtenants and is he entitled to such a high increase? Thanks.

Dr. generally the subtenants are at the mercy of the master tenant -- when the master leaves, at the end of the lease, the landlord has no duty to the subtenants. If the master tenant has a duty to you, that's something to take up with the master tenant.

Given the demand for space, the increases may not be all that wild.
