Hey guys, quick question....

I work in retail sales in a management position, our stores get shopped by 'mystery shoppers' and we receive grades based on our sales reps performance. The corporate office receives these scores and then passes them along to the franchise owners and managers who in turn are responsible for performance.

The owner of the franchise has recently sent an email out to the company group containing this clip:

Commission will not be paid for the month to anyone who receive score below 85 and your portion of commission will be distributed to the person who receive highest score in that month
I'm about to resign from my position in this company soon, but I want to find out whether his latest threat is even legal or not. If not, can you please point me in the proper direction of legislation concerning this issue? Any input is appreciated...

It's completely legal, and from a business perspective makes a ton of sense. He's rewarding the performers.

I would add a qualifier to CheeseBlotto's response. It is completely legal (and I agree that it makes good business sense) AS LONG AS there is no legally binding commission agreement (not all commission agreements are legally binding) that says otherwise.
