I resigned from my position without notice. My employer will not pay my commission from April, even though I was employed with them until May 1st. The reason for nonpayment was that I was not an employee at time of payment. Is this correct?

Senior Member
Unless you were on commission only, Georgia does not generally consider commissions as vested wages subject to the requirements of what is due to an employee and when. In most cases and states, if the commission plan says you have to be an employee when the payment is made, then you do.

However, you can always check with the Georgia Dept. of Labor to confirm.
