What is the name of your state (only U.S. law)? NC (But Agency is in CA)
My wife and I are independant travel agents. We have a contract for 100% commision with a monthly fee to a host agency in California. They have always paid on time up until the end of Sept. at this point they a paying slowly or not at all. When I first found out there were issues, we had a total of $28K that would be due us by the end of November for travel we had booked for clients. They have since paid $8K about a month ago and show a report that we are due $4K for the period ending Oct. 31 but have not paid it. The Nov. 15 report which they have not posted should show over $10K. I have asked many people in the support team when we will be paid and they will only say that they are working as fast as they can to get caught up. However, I know that the majority of the $20K they owe me has been paid to them from the travel companies. The contract states that we are to be paid commisions due by the end of each calender month. Also, I have managed to transfer about 9 bookings out but lost 1/3 of the commission by doing so.
I don't want to keep loosing money transfering out my bookings nor do I want to wait till they file bankruptsy....Any suggestions? Is it too early to be trying anything legal? I know that a majority of the commision would be gone if I involve a Lawyer. (There are many others that are owed too)
