I currently moved to Florida from Texas in Dec 2000. My spouse and I have been together for 9 years never having any children togeher.
I am considering divorcing my spouse and wondering if I would require going to court for dissolution of our common law marriage.
Please tell me my options.

My response:

A common law marriage is a marriage recognized by all 50 States; i.e., if you move from a common law State, and the State you move to is not a common law marriage State, that State will still honor your marriage.

Therefore, a common law marriage receives all rights, protections, assets and liabilities as any other marriage. As such, there is no difference in Dissolution laws between a common law marriage and a "ceremonial" marriage.

In summary, yes, you need to file for dissolution of your marriage.
