I live in Alabama; in the process of divorce. My STBX is living with another woman. How long does he have to live with her in order for it to be considered a common law marriage? Since we are still married, isn't this illegal?

My response:

These are the requirements for a Common Law marriage in Alabama:

Alabama
The requirements for a common-law marriage are: (1) capacity; (2) an agreement to be husband and wife; and (3) consummation of the marital relationship.

There is no time element involved. So, it doesn't appear you'll be getting your STBX in any trouble now, or later. But, it was a nice try, Murtle.
