My response:

Did you ever register your relationship with the County Clerk's office ? If you didn't, you don't have a "Common Law" marriage, and you're free to "up and leave" any time you want, without further actions such as divorce.

Okay, thanks. My previous answer still stands then. You're not married.

Now, all you have to do is get an attorney to file a Petition with the court to obtain orders for custody, child support and visitation.

These orders are extremely important, not only for your own legal safety, but also for the legal safety of the child's present and future.

I won't go into the ramifications of why I'm saying the above; but, suffice it to say, most Family Law attorneys will give you a free initial consultation. While there, you can ask for particulars of my statement to you. It's also my way of getting you to go to an attorney to find out the rest of your rights and responsibilities - - both yours and on behalf of the child.
