My fiancee and I have been living together over a year and a half. he has asked me to use his last name on several documents, such as his lease(i am listed as an occupant) his insurance and several of our bills. i read on a legal info website that in texas (where we live) we are now considered to be common law married. is this true? if we split up, do we have to go through divorce proceedings? i ask this because he has become increasingly violent and has tried to throw me out of our apartment on several occasions. he refuses to let me take my personal belongings, even my clothes and my drivers license. do i have any legal recourse against this?

In Texas, you're not "Common Law" married until you register your relationship, in writing, at the County Clerk's Office.

What? Does he stay in the apartment 24/7 ? Next time he's goes out for booze (which is what ALL Texans do), then get your license and leave. What? He's got a chain around your neck ?
