Common well repair - how much to pay?

What is the name of your state? mi

We have a common well that was shared by 5 homes. there is now 4 homes and a vacant lot ( burnt down in 1990). two of the properties and the vacant lot are owned by the same person. Question is: my deed says I have 1/5 th interest and share in costs. The pump gave out earlyer this year and was replaced. The one guy says I owe 1/3 as there are only 3 different owners. He plans to build on the vacant lot and rent out the other homes (They were unocupied for several years).

ITs also interesting that the pump was working fine until this person had the well re-wired and the well guy who replace it said the motor was gone because of an electrical short had occured.

So, do I owe 1/5, as per the abstract, or more?

if you have documents saying exactly what you are to pay for maintaining the well then why would you have any doubts ? Instead why dont you talk to a real estate atty about how to have this agreement ended if you drilled your own well and explore that as a option .

You only should pay 1/5th.

Even better, you should drill your own well. That many people on a non-public well is dangerous (as in poor water quality).

I'm surprised the public utilities commission hasn't made y'all get certified as a water company (there are so many people on that system!)
