What is the name of your state? Minnesota
Does the lawyer that the executor is using to probate the will have to let the beneficeriars of the trust and will know what is going on in terms of the process of probate. The lawyer my brother in law had draw up my father in laws will and trust and now is handeling the probate is telling us that she will no longer be answering any questions. She says she is only representing the brother in law and father in law not those that are named in the will. She is being paid from the proceeds of the estate. I hope this makes sense and thank you for any help.

You all may be pestering the executor with too many questions, which is somewhat unfair. Try to attend one or more of the probate court hearings to keep informed about what is going on. Let the executor alone to do their job of handling the estate and it is a little bit too soon to be asking so many questions about things, although it is understandable that you would do so.

Thank you both for your replies, actually it was my sister-in-law that the lawyer spoke to and yes she is a bit of a pest. I just wanted to reassure that indeed that was the situation so she could calm down about it. One more quick question, if I call the probate office will they be able to tell me if any probate hearings have been set, I think that is a very good idea since both she and I are doubting we are being told the entire truth about the situation.

FYI ... any assets titled in the name of the trust are not probate assets and pass outside of probate. They are not controlled by the executor as they are not part of the estate; instead they are controlled by the successor trustee of the trust as determined by the trust agreement.
