With our Divorce agreement my ex husband was resposible in paying a loan to my mother. This loan was against my mother's house so we can buy our own house. We lost the house 4yrs after purchase, and he filed for a divorce. In the community debt agreement, he agreed he would continue to pay my mother the remaing monies owed (832 a month till loan is paid, 95,000). Now 1 yr later He has refused to pay her now for 3 months, in doing so now my mom is losing her house. What can I do to enforce his abligation in paying the loan? Please any advice is appreciated :eek:

File for contempt, and in the meantime cover the payment so your mom can keep her house.[/QUOTE]

Agreed. You allowed your mom to encumber her house by 95k - you need to make sure mom's payment is covered, regardless of what he does. Personally, you should have had it set up with you paying mom, and him paying you. Mom's HOME shouldn't be captive to your divorce settlement.
