When my ex husband and I first separated he took our van that was purchased during our marriage and traded it in for a newer truck, and left me and my children with a broken down car. He said that he didn't care anymore, that as far as he's concerned my boys and I can hoof it, we live about 4 miles to the nearest city bus stop. If the boys miss their bus for school, I have no way to get them there. He also changed the locks on the home that he and I still own together, he hasn't bought me out yet, so I can't remove the rest of my belongings. He said I had plenty of time to do it, but I haven't had a car to go over there to get it. What are my rights concering the truck and the house, and my things. Can I legally get part of the truck, he also said that if a judge takes the truck away from him to give to me that he would become a dead beat dad. I can't afford a lawyer at this time to take him back to court and legal aid won't help me. Can you please help. :(

I would get in contact with a womans shelter. They will be able to help you find a place to stay and help get you back on your feet, including your boys. They will probably be able to help you in getting a lawyer to get your ex to pay child support. If the house is in your name and his, then you still have rights towards it. Also if the van was in your name as well, he could get in trouble for selling it without you knowing or concenting to it.

Louisiana; I know we are a community property state and the van was purchased during our marriage, the van was only in his name because I was in the hospital when he purchased it. He traded in the van after he was told that no community property could be sold untill after we settled. We had only been separated 2 months when he traded it in for a newer truck. Since we were still legally married and he used community property to purchase the truck, is the truck considered community property? I am left without a car with 2 children, and about 3 or 4 miles from the nearest city bus stop.

Yes, the truck is community property. He used community property to purchase the truck.

You need to borrow a vehicle and get a police escort to attempt to pick up your belongs. Maybe even rent a uhaul.
