Community property???

Ok so me and my wife have been separated about a year and a half and she refuses to to return or let me have anything that belongs to me. We have no children and there has been no formal seperation or any thing ordered by the courts regarding our separation. Since she refuses to return anything I clearly need leverage. My question is if I go to her job or home and jump in OUR car and leave with it am I breaking any laws or it basically whoever has possession of community property maintained custody untill an order is issued by the courts. I don't care if she gets the car in the divorce I just feel like it's all half mine. I just don't want to break the law by seizing the car. Thanks

Whose name is on the car's title?

We are in Baldwin County Alabama. The car title is in both of our names. It was my credit that got us the loan but I paid it off over 2 years ago and the title has us both listed.

Then you can legally drive the car. However, if you leave her without transportation an she can't get to work, it can go against you in the divorce.

Seriously, unless you have no other means of transportation, do not do it.

Playing games is not your way to get leverage. Filing for divorce is your way to get leverage. Its what you should have done a year and a half ago.

Like I said, I'm dont care if she gets the car but I feel certain that all my things are destroyed and I could care less if she has a ride to work. She left me homeless and has destroyed or given away my property. If I'm gonna get anything out of the divorce I need to have it in my possession. Im not the one playing games. I left the directv on so she could use it and when I cancelled it at her request she told me come to her job to pickup the equipment to return it and when I did she had me arrested for harassment. I proved in court that she told me to come to her job so I beat the charge but I'm not suppose to talk to her unless it pertains to our divorce. I have a jalopy shes more than welcome to drive to work but not my car, never again if I can help it. Also, she has my dogs and refuses to give them to me. Where do I stand with that? I have 3 dogs.

That's one of my pet peeves. I assume you mean that you "couldn't care less".

In any event, no one cares how you feel about it. As you were told by several people, if you take away her transportation to work, it could significantly harm you when you get in front of a judge.

Where you stand with it is you file for divorce and ask for the dogs to be returned to you. If you think the dogs are in danger, you can ask for an emergency hearing - or contact the appropriate authorities. Do not make a false report, however.
