Comp Time

What is the name of your state? MI

A salaried employee was recently terminated due to poor job performance. The employee was the accountant and the poor performance will cost the agency several thousand dollars due to missed report deadlines. The employee is now asking to be compensated for $3000 in "comp time" she said she worked but was never able to use due to her termination. There is no policy on comp time. There is no written approval of comp. time. Does the employer have to pay her?

The employer will probably not pay this comp time. It is best to consult with an employment lawyer.

If this employee was exempt, there is no such thing as "comp time" unless the company policy provides for it.

If the employee was nonexempt, "comp time" in lieu of cash for overtime is not permitted except for employees of government agencies.

Assuming this is an exempt employee, she can ask all she wants but you have absolutely no obligation to pay her for it - nor should you. This is definitely a precedent you do not want to set. If she asks again, just tell her "no." Don't debate it with her.
