What is the name of your state (only U.S. law)? Kansas

A company I wrote a check to has sent me a notice saying my check was returned to them as NSF yet the check has never been presented to my bank for payment (I have double checked my account and even called the bank).

The company is trying to say they will sue me for presenting them a worthless check, and they want a 30 dollar fee on top of the check amount.

Can they do this since the check has never been processed through my account?

Thanks!

Okay, just wanted to update this post, apparently the bank made an error and transposed my account number on the tape at the bottom of the check... I still have to pay the company $30.00 but supposedly the bank will reimburse me.
