Company never sent my disability papers!

Do i have a lawsuit, or what can i do? On april 15th i went to urgent care for severe leg pain, they took me out of work for a week with a follow up with the orthapedic doctor. On april 22nd i went to the orthopedic doctor, he then put me out of work until June 15th.

Because of my not being able to walk without pain, my husband went up to the company i work for to give them the notice and to get disability papers, he was told by the HR manager that the papers had to be in by thursday at noon in order for them to be sent right out, so thursday 8am they were there!

6 weeks yesterday, i still have not received a check, so i call the company i work for ( the old HR manager no longer works there, instead the assisant store manager is the HR manager now) and i was told that they can not find any paperwork on me, so i called the disability number and guess what...i am not in their system! Nobody sent in my paperwork, and now they cant find my paperwork...meanwhile i have been out of work for 7 weeks, no paycheck and my doctor has extended my disability to July.

What can i do, do i have a lawsuit? I mean there is more to this, like how bad they have been treating me since this happened.

From this perspective it sounds like you need to immediately call your insurance carrier, tell them what has happened and put them on notice that you have a claim. You will need to refile them as soon as possible and work with them to expidite your claim considering the circumstances. I'm not an attorney so I can't answer your question about your employer's liability.
