What rights do I have if someone has false used our phone number and my husband's name to obtain credit through a long distance company. That person has incurred a bill of approximately $500 in my husband's name using an old phone # that we have documentation that we did not have for the whole time these charges were made. We have contacted the company several times and are still getting a bill at our address. They have also turned the debt over to collections. If my husband's credit rating is damaged, should we sue the original phone company that was informed of the fraudulent activity, or should we obtain a lawyer and ask for further advice?
