Company owes money but disappears (TN and CA)

What is the name of your state? CA

But the company is in Nashville, TN - I was promised a refund of $4475 for services they failed to deliver since 6/2005, but the company disappeared since 10/2006. I've checked bankruptcy courts, consumer affairs, and the BBB - no luck in locating anyone. Do I have any rights? I have all of my documents.

Q: Do I have any rights?

A: Yes. But those rights have nothing to do with the money you lost.

Go to a search engine and find the website for the Tennessee Secretary of State and go to their searchable databases/SOS BUSINESS link to find the "Business Information Search" link and do a search on this company name to find out names of owners, etc. and the AGENT FOR SERVICE--will show a person's name and address and get that information for your files. Actually it would be better to wait until you have located the owners before you start legal proceedings, so you may want to wait about a month or so (to give the owners time to establish a paper trail of perhaps finding employment or residence in their new city) and hire a private investigator to do a skip-trace/locate on the owners.

Have you decided whether you are going to file a small claims suit to get your money? Then get the papers from the small claims court in Tennessee (or in your county if this company is a national company that may have had an office in Tennessee) and start the process to get a judgment which you can then collect whenever the parties start working or go back into business again.

You have a right to your money, but you have to a) find the defendant and b) they must have assets to pay you. Neither one sounds likely.
