I canceled a year long contract within the agreed time two weeks ago. I called to confirm it was cancelled days ago and one person said no. Another said yes but they hadn't gotten to it. The Mgr said yes and if I was charged I would be refunded.

I was charged the monthly fee. I called and they said they sent the refund request to the billing dept but they were closed. I called back when they were open to talk to billing and they said nobody was available so sent me to the same manager I talked to days ago. I said my HUsband is mad his Amex was charged. I need someone to initiate a refund now. I know it can take days to be refunded but I need confirmation from you that a refund has been initiated. He said he would send it to billing. I said well based on our previous experiences and this one we don't have much faith in your company and without you telling me for sure I am being refunded my Husband will do a chargeback.

He said if you do a chargeback we will bill you for it and the fees I suggest you don't. I said umm we are the consumer and we're charged when we shouldn't have been and we are not even being given any proof that it has been handled just that you will tell billing. So no.

Honestly the nerve to say that is a first for me. They can send me a bill for anything but what is their right? And what is mine? The charge is 19.00 but throughout the year I have several photos and reasons why I canceled my "membership" and left a bad review they got angry about as well. It was an honest review.

The only two questions in your post seem to be rhetorical, so I'm not really sure what your legal question is.
Can you request a chargeback through American Express? Yes.
Can they bill you for that chargeback (assuming they don't prevail with American Express)? Yes.

The real question seems to be whether or not they will actually bill you, and there's no way anyone can answer that with any certainty. My guess (and it's purely a guess) is that they won't bother.

Let me ask you this, though: Did you cancel in some traceable manner?

Yes I e mailed and got an e mail back that to cancel I had to call them to which they say all calls are recorded. Then it was noted on my account the date I called. Then a manager called me back in an hour begging me to stay a customer. This is an HVAC company as if it matters. Now they say they have removed my cc and will refund my money. Amex told me to let them do a CB and if my money is refunded within the 5 to 10 days it takes to refund that to call them and stop the CB but they said the fact I cancelled and got charged that the company basically could screw off. Not how they said it but what they meant. They probably do try to bill people who do chargebacks. I wouldn't put it past them.

These might not be rhetorical questions, but they're pointless questions. Everyone has dozens of legal rights, and it would serve no useful purpose to list them.

You did not ask this question in your original post.

There are two ways that one person/entity can "make" another pay something. One is to do something illegal. The other is to sue. In this case, any suit would be based on the terms of your contract with this company, which none of us have read, so your question is unanswerable.
