i am a licensed realtor for the state of missouri
i signed an independent contractor agreement with shapiro & sons, inc april 2000-july 2001.

i was to be compensated with a draw against commissions. i was
to receive 1/2 up front & the final at closing. i was being compensated with a monthly draw of 1440.00 from april 2000-
december 2000. then increased to 2200.00/month. i never received any of my final closing commissions when the properties sold. i have signed contracts with my name on the contracts.

i have been paid a total of 30,000.00 by means of the draw against the commissions rate of 1.5% of the toal final sale price.
the total of commissions earned is at 68,000.00.

since i could never get this company to sign a mutual agreed upon
contract stating the rate of pay, time frame, etc...., i had to resign myself to receiving my compensation by draw. i thought at least i
am getting some of my money i have earned.

finally growing weary of the "unjust" compensation i resigned on
july 30, 2001. at which time i was informed that i had no monies
due to me. this came by means of a phone conversation between
the father & youngest son of the company.
my question is if i have a case to restitution of unpaid commissions earned.
