To Group and Beth:

We just hired a commissioned only employee in Texas to start 5/1 and has already started working with us. His previous employer had a compensation clause where the employer paid 36,000.00 (3,000.00) plus 10% commission. It also stated in a line after that stating this "you will be guaranteed a salary and commission compensation of 4,000.00 per month". Some months his 3,000.00 plus 10% did not meet the 4,000.00 criteria and he was owed money. The company would say they would eventually pay him. Well, he is no longer there and has been paid thru 5/1 and is still owed an estimated 2,800 - 3000+. In Florida, will he have luck getting this???? He is a good guy and I hoping we can help him recover this money via legal means.

Ya got me. Perhaps one of the attornies will offer an opnion. I will only suggest that it might not be a good idea for you, the new employer, to get embroiled in a dispute with this employee's former employer. I might do a little fact finding for the employee but then let him handle it himself.
