Hi everybody,
If one party in a contract breaches the agreement, then what type of damages the defendant is most likely to held liable for? Is it compensatory or punitive or both. Thank you.

Unless you can prove "bad faith," then all you're going to get is compensatory damages.

Thanks for your response :)

What about liquidated Damages (damages specified in the contract that would be payable if there is a fraud)? Can we say that it all depends on the terms in the contract, or is compensatory is all what the plaintiff is going to get?

Is there a liquidated damages clause?

I'm talking generally.

I found this statement online and was wondering how accurate it is:

"You generally cannot collect punitive damages in contract cases"

That's a true statement -- generally. That's why I mentioned "bad faith" because that's the exception to the rule.

So, with all of your questions, and your failure to answer my questions, I can only conclude that you really know nothing about "contracts" and you're just fishing around.

Have a nice evening.
