Hello,

We are in the Anti-Spyware software industry for the last 5 years. A large anti-spyware software company is now removing our anti-spyware software (Competing Software) form the user's machine. This is Software Sabotage and Unfair Competition Law. Their claim is that we have false positives, or low detection rate. We have probably a larger database than theirs, and we were tested in a computer magazine test, and came ahead of them in the results, which clearly shows we are even better than them. Right after this Magazine test, they added us to their software removal database list, and this has cost us a great loss in revenue, and also got us added by other anti-spyware tools that followed. Anti-spyware software programs are supposed to remove spyware/adware but not the competition? We seek advise, and will be looking for a good lawyer to go after those companies that remove our software.

What kind of advice are you looking for? You've already stated that you are going to hire a lawyer -- do that, and let that person figure out how best to go after these other companies. That's the best advice in your case anyway.
 
Does the competition allow the user to choose to remove the software, or does it just "do it"? For instance, does it identify your software and allow the user to select/deselect it from a list for removal, or does it remove it behind the scenes?

Does your software utilize any sort of streamed-to-client advertising? Does your software collect any metrics based on usage or findings?

Do you charge a subscription fee for getting updated spyware definitions? Is your software client tiered, as in a basic option and a premium for-pay option?
