Competitor trying to hijack my product name

What is the name of your state? Outside US (Portugal).

First some background.

I develop and sell a software program called System Cleaner. It's used to clean junk files and perform other maintenance tasks for your computer. It was first released back in November 22 1997 and I have sales since that year.

Some time ago I discovered that a company (3B Software) is using the name "System Cleaner Pro" on a software product. A competitor of ours. After sending them an email they said that "we have been advised by legal counsel that System Cleaner and System Cleaner Pro are two legally distinctive names. Nevertheless, in order to reduce any chance of potential
customer confusion, we will change our product's name to 3B Software's System Cleaner Pro.".

Well, they never changed the name and they even pulled a nice stunt a few days ago by submitting their program to download.com (the biggest software download web site) as "System Cleaner 5.0". Of course, mine is listed as "System Cleaner 4.92".

The biggest problem here is that I'm located in Portugal and they are in the US.

Any advice on this complicated matter?
