I am leaving my current employer due to several problems involving employee and customer safety as well as management issues and company compensation practices. I will be discussing all the issues during my exit interview if granted my request for one. I plan on making the same complaint to the Labor department and OSHA. If problems are corrected before any subsiquent government investigation can I possible be held liable for false statements should the company deny existance of the problems they "repaired". In short, should I be professional and make my complaint BEFORE or AFTER I RESIGN and SHOULD I or SHOULD I NOT, tell the company of my complaint to enforecment agencies.

As long as your complaint to OSHA or any gov't agency is made in good faith, you should be fine. Good faith means that you legitimately believe that an unsafe condition or violation of the law exists, even if you are mistaken. A complaint not in good faith would be one where you knowingly complained of an untrue violation merely to make life difficult for the employer. It is very hard for an employer to demonstrate that a complaint wasn't made in good faith.

Whether you want to file a complaint, do it before or after you leave, or tell the employer of your intentions is up to you.
