I have a very complicated situation. I am in VA. In 1995 my husband and I separated. As in we went our separate ways. Because our lawyers were both more interested in complicating matters we never signed separation papers. I remained in the house with my 2 daughters. In 1999 he lost his good job and was having a hard time finding housing. I allowed him to move into the basement, I thought for a weekend, a week at the max. The following year he became totally physically disabled. Now I am stuck with him in the basement. I would like to have a divorce and do not know if I can get one, if a judge would see the situation for what it is. Also, we have been legally married for almost 19 years. Is there any reason to hang on for 1 more year to 20? He will not recieve any retirement, but did not know if it makes any difference with ss. I do not want to be stuck with his bills. I would like to keep the house with out him in it or would like to move out but do not want my name left on the mortgage and there is no way he could get a loan to buy me out.
I appreciate any help. Thanks
