In the month of October, I signed on to the lease with a co-worker. Two months down the road, she wanted out and was threatening me that she was going to break the lease which would cost us $2100 + court fees. Out of desperatation I offered a couple at work to take her place on the lease. In the 2-3 months that they've lived with me, they managed to stink up the house due to not keeping up the maintenience with their pets, almost evict me twice, refuse to take responsibility in signing onto the lease, and smoke pot on the premises (I told them before they moved in that I didn't care if they smoke marijuana, it just can't be in the house or on the balcony). I am currently working things out with the leasing office to transfer into a 1 bdrm. However, I need to clean the apartment before I vacate. So I told them that they needed to move in two weeks so that I can start cleaning, in return, I would pay for the damages their animals made. When the 2 weeks were up, they refuse to leave!!! What should I do??? One of them was telling me I needed to give them 30 days because they are sub-leasants. However I don't understand that because the main leasant is my old roommate and that would make me a sub-leasant, right???

You are the Landlord's tenant per your lease ...

They are your tenants (month to month - at will) ...

You need to follow your States Landlord/Tenant laws, which very likely require a 30 day written notice to vacate.

If you give them notice today, they will have until May 31 to vacate the apartment.

Put their crap out on the sidewalk and tell anyone that knocks on the door that you let them stay over for a couple of days to help them out, then the next thing that happens is they bring animals in and refuse to leave they are doing drugs and they have started peddling pot from your unit, people are knocking on the door all the time being given something then walking of.

If they turn around and say their mail is delivered there deny any knowlege of this and state you did not give any permission, they were only supposed to stay a few nights and you certainly do not tolerate drugs and drug dealing.

If that does not work call the cops everytime you smell pot smoke and let the cops in when they arrive

Send a CRRR letter to the LL stating that the roommates are using drugs and you are concerned not olnly for your personal health and safety but also for all the legal ramifications associated with drugs, and if the LL refuses to do anything about the situation you will be forced(for your own protection) to notify the police of the situation and mentio to them(police) that the LL was notified and refused to do anything.
You can personally or CRRR letter the roommates with the same letter, although worded a little differently along with the 30-days notice to vacate. Include in the letter that the next time you see drugs in the apartment it is a violation of a month tio month lease(which is what they have with you). and you will evict the m IMMEDIATELY and/or call the police.

Keep a record of the letter somewhere safe! Preferrably somwhere other then the apartment. If you do have to call the police, show them the letters you sent/gave as this will support your position of trying to deal with the matter.

Remember, even though they are a month-to-month tenant and have not signed a lease with all provisions, they still have to follow the states LL/T laws. Most states LL/T laws have a clause in them under Reason for Eviction which states: any tenant using illegal drugs is grounds for immediate eviction.
