Computer Monitoring Software Legal?

In Texas: is a program like SnapShot Spy legal? This is a program which takes "pictures" evry 10 seconds or so, hidden from the computer user, to record all activity being performed on a computer - the program can be readily purchased via the internet. What are the laws regarding use of such "spy" software?

This is not at work, but for one's own personal computer. My friend has evidence that her husband is having an affair - she loaded the program onto their family computer and "captured" screen images containing further email communication between her husband and his long-time lover. Was this illegal under this home circumstance and could such evidence be admissable in a divorce proceeding? The evidence proves he committed perjury in a deposition already taken.
