I purchased a brand new Packard Bell PC in June 1998, at that time, I also purchased a 3 year in home service warranty. No details of the warranty were ever given to me. In April of 2000, I had to contact them for service on my PC because a part had broken that made it impossible for me to use my CD ROM drive. First, they told me that the warranty was not in place because it was under the manufacturer's warranty. The warranty company had my date of purchase wrong in their records. I was instructed to fax a copy of my original sales receipt so they could correct the date of purchase. In July 2000, a service tech came out to my home and determined what part needed to be replaced and said the order would be placed and they would get back to me about fixing my PC. Well, 7 months and many fights later, my PC is still not fixed. Today, I was told that the part that needs to be replaced is on "National backorder" meaning no vendor in the country can get it or will be able to get it. It's basically unavailable. Tonight I was told by a representative of the warranty company that the part is either unavailable or too expensive to get and is therefore not cost effective to repair. He said the options will be to either replace my PC or to cancel my agreement and refund the original purchase price to me. Is it legal for the warranty company to cancel my agreement just because they may have to replace my PC? Any help is appreciated, the warranty company is supposed to get back to me by the end of this week with their decision on what they are doing.
