I've been married for one month now and my husband has a 2 year old child. We live in the state of Georgia. The child mother just moved here from Maryland with her boyfriend and they have no job, no car, and his little girl barely have food to eat and clothes to wear. His little girl was living with us for a while and now her mother has took her back. Mind you her mother lives with some friends in a one bed room apartment and there are three other couples living there. My question is what steps would we need to take to file for custody for his child. Also he wanted to put himself on child support, so that she wouldn't be able to not allow him to see his child. However, he was told that she would have to file or he would need to hired an attorney. Please send me some advice on how to handle this situation. My only concern is what is best for the child at this current time. Thank You in advance.

Support and visitation are seperate issues. It sounds like mom is pretty bad off finance wise, so if she is on any welfare, your husband will be taken in for support. Were she and your husband married? If not he needs to have a paternity test taken.
Is there any visitation order or custody order? If not your husband needs to go to the clerks office in the county the child resides in and file for temporary custody (you can file for emergency custody if the child is in danger). He can also file for visitation if he doesn't want to file for custody.

Have you ever considered that the child being with his mother may be what is best for him? If you and your husband do not approve of whom they are staying with in order to survive at the time, invite the mother to stay at your home with the child until she has a chance to "get back on her feet". I know it may seem wrong to have your husbands ex and their child staying in your home, but that is the mother of his child and I am sure that the child would be very thankful to you for it later.
