I live in the state of California and my legal parent or guardian lives in California as well. If I move to Washington without my parents(but with their consent) where the legal age of consent is 16, and I get into a relationship, which law takes precedent the Washington law or the California law?

I heard that if I live somewhere else other then with my parents I have to abide by the age of consent laws of the state they live in. Is this true?

What difference does it make? I ask because you use a lot of "if"s in your post -- sounds like this has not happened.

How old are you? How old is your "intended"?

I am going to be 16 in a few months. There is no intended I just want to know for future reference. This is a legal advice forum right?

So far I have received no legal advice so I was starting to wonder. Are there any lawyers on who could answer my question?

Sounds quite suspicious to me.

I mean, if there is no "intended", then why are you even contemplating the question? Plus, what parent or guardian in their right mind would allow their underage child to move to another state without them? ESPECIALLY when it appears there is an adult with sex on their mind waiting for them there?

Someone is trying to cloud the truth here to get the answer they want... SOMEONE is not telling the whole unadulterated story.

We don't *do* hypotheticals. Waste of time.

If you want to learn for your own pleasure, read around the juvenile forum.

You were given legal advice. Google "Mann Act".

Your 'sweetheart' could be spending a lot of time in jail and you could be coming home to an empty apartment - no family, no friends, and, unless you can support yourself, no utilities or food, either.

Oh one more thing that I failed to mention...

If OP is planning on crossing state lines just to try to get around the state laws regarding age of consent, then there are probably FEDERAL LAWS that deal with their situation.

Federal authorities tend to frown on adult sexual predators who lure underage targets across state lines to get their rocks off and avoid state prosecution... :D

So, you are both residents of California.

If I move to Washington without my parents(but with their consent) where the legal age of consent is 16, and I get into a relationship, which law takes precedent the Washington law or the California law?
That depends. Will you be a legal resident of Washington? or, will you be considered on vacation?

If someone in WA has legal custody and you are registered to attend school and live there, then you can be considered a resident there for such purposes. However, your paramour can still be charged with a crime depending on HIS age, and if he commits so0me other offense such as encouraging you to be delinquent, disobey your guardians, etc.

Plus, if some guy encourages and aids you to cross the border for purposes of a sexual liaison, federal charges can be brought.

This is a bad idea. And any parent who permits a child to attend another state simply to get their freak on should give up that child before they do any great harm to said child.
